Understanding Your Rights: The Magnuson-Moss Warranty Act and Florida’s Lemon LawBy Robert Baldwin, Esq. | Baldwin Law, LLC
When you purchase a new or used product—especially something as costly as a car—you expect it to work as promised. But what happens when it doesn’t? Fortunately, both federal and state laws are designed to protect consumers from defective products and misleading warranties. Two of the most important tools for consumers in Florida are the Magnuson-Moss Warranty Act and the Florida Lemon Law.
The Magnuson-Moss Warranty Act: Federal Protection for Consumers
Passed by Congress in 1975, the Magnuson-Moss Warranty Act is a federal law that governs consumer product warranties. Its goal is to ensure that warranties are clearly written, fully disclosed, and honored by manufacturers or sellers.
Key Protections Under the Magnuson-Moss Act:
Plain Language: Warranties must be written in clear and understandable terms—no legalese.
Disclosure Requirements: Sellers must disclose warranty terms before you buy the product.
Full vs. Limited Warranties: A “full” warranty must meet certain criteria (e.g., free repair or replacement, no time limit on implied warranties). Anything else is “limited.”
Right to Sue: If a warrantor fails to comply, you can sue in state or federal court and recover attorney’s fees if you win.
Applies Beyond Cars: This law covers a wide range of consumer products that cost more than $10—think electronics, appliances, and even mattresses.
💡 Example: If your new refrigerator breaks repeatedly and the manufacturer refuses to repair it properly under warranty, the Magnuson-Moss Act may allow you to take legal action—and recover your costs.
Florida’s Lemon Law: Protection for New Car Buyers
While the Magnuson-Moss Act applies to all types of products, Florida’s Motor Vehicle Warranty Enforcement Act—commonly known as the Florida Lemon Law—specifically protects buyers of new vehicles that turn out to be defective.
What Qualifies as a “Lemon” in Florida?
A car is considered a “lemon” if:
The defect substantially impairs the vehicle’s use, value, or safety;
The defect arises within the first 24 months after delivery;
The manufacturer has made at least 3 repair attempts for the same issue—or the car has been out of service for 15+ cumulative days—without a successful fix.
If these conditions are met, you may be entitled to a refund or replacement vehicle.
Florida’s Lemon Law Rights Period
The "Lemon Law Rights Period" is 24 months from the date of delivery. During this period, the consumer must notify the manufacturer and follow specific procedures, including sending a Motor Vehicle Defect Notification if required.

What Should You Do if You Have a Defective Product or Vehicle?
Keep Records: Maintain all receipts, service orders, warranty documents, and communications.
Follow the Warranty Process: Always attempt to resolve the issue through the manufacturer first.
Send a Written Notice: Formal written notice is often required to preserve your rights.
Know the Deadlines: Florida’s Lemon Law and Magnuson-Moss both have time-sensitive requirements.
Get Legal Help Early: Don’t wait until you’re frustrated. A lawyer can help you navigate these procedures efficiently—and you may not have to pay out of pocket if the law allows for recovery of attorney’s fees.
